Employment
Law

In the last 15 years, employment law has evolved and developed
at an unprecedented rate. It is an onerous and daunting task for
any employer, big or small, to keep on top of the regularity with
which new employment laws are implemented. The recent advent of
the new Equality Act 2010 is an excellent example of how quickly
the law changes and yet employers are expected to respect and understand
the vast number of rights that their employees have in this unforgiving
area.
A claim against a business can have damaging consequences, such
as:
- Having to pay compensation to an employee out of court or after
a lengthy trial
- Having to pay legal fees for defending cases, even those that
do not succeed
- Investment of time and resources in defending claims
- Adverse PR
- Effect on tendering for contracts and public perception of
companies that are successfully sued
- Adverse effect on staff morale
- Time, stress and hassle
2010 saw a 56% rise in the total number of claims going through
the employment tribunals meaning that, last year, over 236,000 claims
were accepted in tribunals in the UK. Compensation for discrimination
claims is a particular concern for employers since the amount that
a tribunal can order an employer to pay is uncapped. The largest
award last year was for £729,347 in a claim brought by a sports
writer for the News of the World following his dismissal in April
2007 whilst on long term sick leave because of stress related depression.
